What's on this agenda

One rezoning: 20.51 acres at 9825 NC Highway 49 in Cedar Grove, from agricultural residential to a non-residential conditional district, so the county's own alcohol board can build a store there. The published agenda packet is larger than this site's document relay will pass through; this reading is taken from the approved minutes.

Meeting recap

What happened, drawn from the records published after the meeting. Minutes

The board recommended against it, 7-4, and the four who wanted it approved said so on the record.

The applicant is the Orange County ABC Board, the county's own alcohol retail agency, with a design firm acting for it. Its case: the site is already disturbed land that once held a nursery and landscaping store, the state alcohol board has already approved the location by its own standards, there is no ABC store within ten miles, the store would be the only thing built on the parcel, and the architecture would follow a Kentucky bourbon style. The parcel sits at a visible, heavily trafficked intersection which the development ordinance identifies as an industrial node, with commercial land across the county line.

The board's split was not about whether the use fits. Members who favoured it argued that a site this exposed to traffic will never be quiet and cannot realistically be used for anything but industrial or commercial purposes. Members who opposed it did so on the comprehensive land use plan, which is what a statement of inconsistency addresses: the vote was on whether the proposal is inconsistent with the plan, not on whether it would be a nuisance.

The discussion had already worked out what conditions would make it acceptable, which is why the chair recorded that he would consider approval with them. Members wanted a conservation easement over the remaining 17 acres, which is prime farmland, and debated whether such an easement could preserve farming or forest rather than simply bar construction - staff and members agreed the county cannot compel its own alcohol board to farm. One member asked that the applicant replace rather than merely maintain the Cedar Grove sign, so the project contributes something to the corner it sits on, and pressed for a stronger landscape requirement than the 20-foot buffer proposed, part of which is interrupted by the septic field.

The vote itself needed running twice: the chair had to restate the motion because voting for a statement of inconsistency means voting against the rezoning, and members are not permitted to abstain. Seven of eleven voted for the statement.

The board also deferred approval of its own July minutes to the following meeting, and the presentation was delayed at the start because the podium computer had failed and staff had to mirror a laptop wirelessly.

How the votes went

The statement of inconsistency passed 7-4, which means the board recommended the county commissioners refuse the rezoning. Four members opposed the statement and would have recommended approval with conditions. Abstention is not permitted. Approval of the July regular minutes was deferred; the July committee summary was approved unanimously.

20.51 acres from agricultural residential to a non-residential conditional district, applied for by the Orange County ABC Board so it can build a store. The site is previously disturbed land that held a nursery and landscaping store, sits at a heavily trafficked intersection the ordinance treats as an industrial node, and has state alcohol board approval; the nearest ABC store is more than ten miles away. Members discussed a conservation easement over the remaining 17 acres of prime farmland, replacing the Cedar Grove sign, and a landscape buffer stronger than the 20 feet proposed, part of which is broken by the septic field. The disagreement was about consistency with the comprehensive lan…
