Cary's zoning board of adjustment adopted the resolution on December 1 granting the Scottish Hills Recreation Club a special use permit and development plan to heat its outdoor pool for year-round use, and to expand a legal nonconforming use. The lighting condition was worked out on the floor. The applicant offered a 9:30 p.m. cutoff for off-season months, which effectively allows operation until 9 and time for people to leave. Board members then asked whether the parking lot light should be caught by the same condition and decided it should not, on safety grounds, so the condition was written to cover swimming pool lighting only. The parking lot has one light, controlled by Duke Energy, and staff noted parking lot light levels are far lower than athletic field lighting.
The site sits on the south side of Tarbert Drive, across from Annie Jones Park, with detached houses to the southeast and west and attached housing to the south. The eastern half holds the pool, tennis courts and parking; the western half remains wooded.
The board also reviewed its tentative 2026 meeting dates, moved for January and September to avoid holidays. Members considered starting earlier than 6:30 p.m. and decided to keep that time, but asked the clerk to check whether meetings with no business items could start earlier. This meeting adjourned at 6:47 p.m.
