Wake Forest's Board of Adjustment takes its first hearing on BOA-23-05, a setback variance for three lots around the Sun Meadow Drive cul-de-sac in the Radford Glen subdivision. Taylor Morrison, which bought the lots from the developer, wants relief from the maximum garage and front setbacks that the neighborhood's own rezoning conditions imposed.
Staff say the ordinance already offers a way out. A 10 percent administrative modification, or 24 inches, whichever is greater, can be granted without any variance at all, and staff's position is that all three lots can meet both setbacks that way. The board hears the case as a quasi-judicial matter, so witnesses are sworn and a variance needs a four-fifths concurring vote.

The board tabled the variance. After hearing the staff report and a presentation from an engineer at McAdams for Taylor Morrison, members could not agree to approve or deny the required findings of fact, and voted unanimously to carry BOA-23-05 over to 21 March. The meeting adjourned at 7:43 p.m.
Most of the questioning turned on the first finding, unnecessary hardship, and on whether the lots could comply without a variance. Staff said they could, using the 24-inch or 10 percent administrative deviation, and confirmed under questioning that the town's position is that all three lots can meet the ordinance. The applicant's engineer said flipping the house plans to change the driveway angles had been considered but would break the minimum setback on one lot, and that the neighbouring lot 18 had already been sold and built.
