Both cases divided the board, which is unusual for it. The Beer Box outdoor seating permit carried 3-2 and a related motion 4-1. The chair opened by setting out the quasi-judicial rules — the board sits as a judge and may take only competent evidence — which is what makes these hearings different from the legislative rezonings the council handles.
