What's on this agenda

Chatham County's Planning Board recommended denying both halves of the Summit Church rezoning on 1 October 2024, unanimously. The commissioners did the same in December, and the church sued the county.

The board also recommended New Hope Overlook, 22 lots on 45.115 acres off New Hope Church Road, and took two items on consent: a phasing revision for Vicker's Village and a final plat in Fearrington.

Meeting recap

What happened, drawn from the records published after the meeting. Minutes

Every vote was 8-0. New Hope Overlook was recommended 8-0. Both rezoning requests were refused 8-0, each with an inconsistency statement 8-0.

The arguments on the church ran along three lines. On rural character, a member read the comprehensive plan's description of Chatham as forests and fields dotted with barns, silos, churches, poultry houses and general stores, and said a megachurch does not belong in that list. On law, another member reported his own research: refusing a rezoning for lack of revenue could be discriminatory and raise First Amendment problems, and the federal Religious Land Use and Institutionalized Persons Act governs religious land use, but the board's own reading that the traffic is unsafe and inconsistent with the land use plan is a sound basis. He asked for more guidance from the county attorney in future cases of this kind.

A third member made the numbers argument. There is no right to a rezoning; an applicant has to show the change is better than what is there. The compact community approved in 2021 and 2022 requires 30 percent open space, 30 acres on a 100-acre parcel, against the 18 acres this proposal sets aside, a net loss of 12 acres. On revenue, 46 residential units under R-1 at the county's $655,000 median comes to about $257,000 a year, against roughly $856,000 from the 151 units the compact community would bring, a $6 million difference over ten years.

Another member put it as scale: the compact community is the right idea for the site, including churches, but churches of about 300 people, and this project belongs where the infrastructure is.

How the votes went

Both Summit Church rezoning requests were recommended for denial 8-0, each with an inconsistency statement 8-0. New Hope Overlook was recommended 8-0. The agenda with its two consent items and the September minutes were approved 8-0.
