Christopher Erickson asks the board Thursday for a setback variance so he can finish permitting a garage already built at 513 Red Bud Road. The garage sits on the footprint of an old carport, inside the 10-foot interior setback and a drainage easement. Town inspectors found the encroachment at final inspection. Erickson writes that his first contractor poured the slab there and then stopped responding, costing him about $50,000, and that the slab passed later inspections without the easement being raised. Staff have drafted resolutions both ways, and the board must find all four hardship tests in the town's land use ordinance to grant it.

The board also signs its written order on 739 Gimghoul Road, heard October 1. The draft grants Vicki Parrott a variance to build an accessory dwelling on the footprint of an existing garage, up to 17 feet into the street setback on Evergreen Lane and 6 feet into the interior setback. Officer elections close the agenda.
