Regular meeting Health and human services

What's on this agenda

The board approved a special use permit letting an in-home daycare on Forest Fern Lane grow from six children to twelve, on a 5-0 vote with all four findings of fact carried unanimously.

One neighbouring family appeared in opposition out of roughly thirty to fifty owners notified within 200 feet. The board's own difficulty was narrower: it had no evidence about property values, and got to the third finding of fact by leaning on the clause allowing a use to qualify as a public necessity instead.

Meeting recap

What happened, drawn from the records published after the meeting. Minutes

The petitioner has run a licensed home-based childcare at the address since September 2025 under a home occupation permit issued in November 2024 for up to five children. She told the board she holds a bachelor's and a master's in education, has the maximum administrative level by equivalency in early childhood education, and carries a five-star licence, which she said makes her the only in-home daycare in the town rated that highly. She teaches in English and Spanish and introduces basic American Sign Language, and said all five children currently enrolled are speaking three languages.

Parking took the longest. The household keeps three cars, two in the garage, and drop-offs are staggered from about 7:50 to 9:00. Parents park in the driveway and come inside, and the co-owner said that when the driveway is full some park briefly on the road, no more than five minutes. A member pressed on what happens if assistants are added, since any additional worker would need one of the two onsite spaces.

That led to the meeting's clearest correction. The petitioners had planned to bring in a part-time assistant, a parent recently laid off, partly so she could keep her child enrolled while looking for work. The planning director explained that the town's home occupation standards do not permit employing anyone who does not live in the dwelling, and repeated it to both petitioners. They said they would consult their accountant to stay compliant.

On noise, the co-owner said neighbours had texted twice asking that children's music played outdoors between 11 and noon be turned down, and that they complied each time. The chair noted only three people attended the neighbourhood meeting and one family opposed, and took that to mean most notified owners were not objecting.

Members weighed the third finding openly. One said the board was relying mainly on the neighbour's testimony and did not have all the information it might want. The vice chair said she struggled with the property value half of the finding and was comfortable only because of the public necessity clause; another member agreed the board simply had no facts on values. All four findings and the permit then passed 5-0.

How the votes went
