Orange County's Board of Adjustment met Aug. 13 to hold a quasi-judicial hearing on a single variance request: property owners James and Tammy McHale sought a 10-foot reduction to the required 40-foot front setback along Eno Cemetery Road, to a 30-foot setback, for a 0.47-acre unaddressed parcel in the Cedar Grove Township.

The board also had before it its June 11, 2025 minutes for approval. The document available at posting time contains those June minutes and the staff report package prepared for the McHale hearing, but not a record of what the board decided at this meeting; that will appear in minutes approved at a later meeting.

The Board of Adjustment held the quasi-judicial hearing on the McHale variance as scheduled, with no opponents signed up to speak. Staff planner Jack Moran and applicant's agent David Cates testified that the 0.47-acre lot at 4310 Eno Cemetery Road is boxed in by reservoir, well and septic setbacks, leaving one buildable area for a 750-square-foot garage with two bedrooms. Property owner Tammy McHale told the board the proposed garage would look like a similar structure across the street.

The board voted unanimously three times: to adopt findings of fact based on the application and the testimony, to find the request met all four variance criteria under UDO Section 2.10.4, and to approve the 10-foot front setback reduction, from 40 feet to 30 feet, along the Eno Cemetery Road right-of-way. No member opposed any motion. It also adopted its prior meeting's minutes without discussion.

How the votes went

All three motions on the variance passed unanimously with no dissent: findings of fact (moved by Beth Bronson, seconded by Greg Niemiroski), the four variance criteria under UDO 2.10.4 (Bronson, seconded by Kyle Myers), and final approval of the variance (Bronson, seconded by Kyle Myers). Present and voting: Chair Leon Meyers, Vice Chair Beth Bronson, Jeff Scott, Greg Niemiroski and alternate Kyle Myers. Member Nathan Robinson was excused.
